The year-old malpractice lawsuit stemming from the death of a six-year-old North Platte boy saw both sides ask for an extension of the deadline for the plaintiff to identify expert witnesses. On March 31 2009 Tracey Curtis filed suit against Drs. Douglas States and Wayne Weston, Jill McAdam, States Family Practice, and Great Plains Regional Medical Center over the death of her son on April 13, 2007. The suit alleged that the defendants failed to identify and treat sepsis that the boy developed after falling and injuring his arm April 9. In an answer filed May 1, 2009, States and McAdam denied any culpability in the child’s death. They asserted that the death “was caused by intervening or superceding causes over which defendants had no control.” In December 2009 Curtis decided to remove the hospital and Weston from the lawsuit. A document filed in Lincoln County District Court March 1 2010 stated that unforeseen delays had set back the timetable for taking depositions. The document read that States was originally scheduled to be deposed Oct. 21, but was delayed due to an outbreak of flu amongst his patients. In addition, a physician who had been working in his practice took another position and States had to cover his patient load. The motion said that Jan. 26 was the first day States and all the attorneys were available for a deposition. The progression schedule called for Curtis to identify her expert witnesses by Dec. 18, but since States was not deposed until January both sides of the lawsuit requested that the deadline be extended until March 18. They also asked that all other deadlines be delayed in a similar fashion, for an additional three months. Attorneys for both sides signed the document.
