The North Platte Police Department arrested a man over the weekend for his role in an August 2009 assault. Teddy Magallanes was picked up March 5 and charged with second-degree assault. The incident in question took place August 16, 2009, but the investigation had stalled until recently. Leroy Bowers, the man Magallanes is accused of assaulting, identified Magallanes from a photo line-up last week, according to Lt. Mike Swain. Bowers was also arrested in the incident, as was Ed Hagert. A police spokesperson sadi in August that a friendly gathering at the 1500 block of N. Bryan turned ugly when the fight broke out on the porch on the front porch. Officers responded to a report of an assault at 10:30 p.m. When they arrived on the scene, Bowers greeted them. The officer reported that Bowers was favoring one arm and had a laceration on his face. Bowers told police that he had been hanging out with friends, drinking and generally having a good time. The problem began when Hagert called the owner of the house and asked about coming over. The owner told him not to come, but Hagert arrived shortly thereafter anyway with a companion now identified as Magallanes, the spokesperson said. Once Hagert was inside the house, Bowers reportedly confronted him about an unspecified incident at a bar that took place a few days before. The argument got heated and the owner of the house told Hagert and Magallanes to leave. The pair exited the house and Bowers followed them outside. Bowers told the responding officers that Magallanes took issue with Bowers disrespecting Hagert. Hagert tried to convince Bowers to come off the porch so they could fight. Bowers reported that Hagert lunged at him, prompting him to grab a floor lamp in what Bowers maintained was self-defense. Bowers struck Hagert with the lamp, which broke. Bowers then procured a metal fishing rod holder and hit Hagert in the head, causing a wound that required many stitches to close. Bowers said Hagert hit him with a small, hard object during the fracas. Hagert and his companion left, vowing to return to finish the fight. For his part, the police allege that Magallanes struck Bowers with a rake. Both Hagert and Bowers were treated at Great Plains Regional Medical Center. At the hospital Hagert initially claimed that he had fallen down stairs, the spokesperson said. He then refused to tell the police anything more. Bowers pleaded no contest to third-degree assault in December and paid a $100 fine. Hagert pleaded guilty to the same offense and was sentenced to one day in jail in August.
