Alyssa Deibert entered her plea before Judge John Murphy. She also pleaded not guilty to violating her probation.

Deibert’s attorney, Pat Hays, moved that her bond be lowered, citing that she has spent over a month incarcerated for the alleged offenses. The county attorney’s office opposed a reduction due to Diebert’s history of drug offenses.

Murphy set the bond at $10,000. Diebert is next due in court March 22.

The crime

A North Platte woman was arrested and charged with cocaine possession after bringing drug paraphernalia with her into a meeting with her probation officer.

Sgt. Steve Reeves of the North Platte Police Department reported that Alyssa Diebert, 26, was searched by her probation officer during a scheduled appointment Wednesday.

The search turned up a monetary bill that police believe was used to snort cocaine, Reeves said. The bill tested positive for the drug and is referred to as a “snorter.”

A subsequent search of Diebert’s home yielded more snorters, plus baggies and a mirror that had cocaine residue on them, Reeves said.

Diebert was charged with possession of cocaine, a class-four felony. It is punishable by up to five years in jail, a $10,000 fine, or both.

In addition to the new charges against Diebert, four alleged probation violations against her by Marty Beyer, a probation officer.

Beyer claimed that Diebert violated four terms of her probation in a document filed in Lincoln County District Court Thursday. The violations were:

• Failing to refrain from unlawful conduct.

• Failing to abstain from using alcohol.

• Failing to attend aftercare and Narcotics Anonymous meetings.

• Being in contact with Justin Chilcott.

Diebert was sentenced in April 2009 to three years of probation for an incident in April 2008 when she and her live-in boyfriend at the time (Chilcott) started their home on fire while cooking meth.

Diebert’s two young children were in the home at the time and were forced to flee with the couple. Firefighters discovered a meth lab while battling the blaze at 1616 N. Jackson.

Chilcott received two to six years in prison for that incident. Diebert was referred to as “meth mom” by then Bulletin editor Frank Graham while covering her court cases.

Beyer wrote that Diebert admitted to using and tested positive for cocaine and alcohol Jan. 27.

He also said she admitted to using and tested positive for marijuana in Sept. 2009, and alcohol in May 2009.

Diebert has also failed to attend mandatory NA/AA meetings and other counseling on a regular basis, Beyer alleged.

Finally, Beyer accused Diebert of contacting Chilcott via text message in early January. Chilcott was arrested Jan. 3 for manufacturing methamphetamine. A witness statement from an affidavit in support of a search warrant to search the home of William Reed (Chilcott’s alleged meth making partner) claimed that Diebert and Chilcott had been hanging out and using drugs together in December 2008.

Beyer wrote that Diebert is believed to have been providing chemicals to Chilcott to manufacture the drugs. However, Reeves of NPPD said that no charges had been filed against Diebert stemming from that incident, and he did not believe any would be.

Beyer asked that Diebert be forced to serve a straight term of incarceration for violating probation.
